Need Assistance - Asap

Good Morning All,

As most of you know my daughter, K, is in a mental institution and was on a 3 day hold which was extended to a 14 day hold...every psych patient in the state of California can have a hearing two days after lock down (if they are put on a 5250, 14 day hold)....okay, so she definitely wanted the hearing, no surprise, and she doesn't want us there...no surprise...however, if she is deemed capable of being released today, what are my rights? I have a call into the Patient Advocate Rights division at Los Angeles Superior court and they will hopefully call me back before the hearing. I'm hoping to take several young AAers over to see her prior to her hearing. They are ready and willing to do a panel with her. However, again, this is all contingent on her rights....her Dad and I will be refusing to take her back...she is still defiant and had an outburst at the hospital with some other kids yesterday. If she is released today we have plans to take her directly to an Inpatient Treatment facility out of town.
But, she doesn't meet the three criteria to keep her detained (per her Social Worker):

1. She is in an active suicide state

2. She is in an active homicidal state

3. She is psychotic

Currently, she is on Depakote...since Monday, I believe. Just thought I'd throw that in. Her Dad and I again, will be going to the hospital with her sister this morning and the AA young people and a "Keep the Peace" officer.

Any suggestions, advice or help would be appreciated. Again, I am under the jurisdiction of Los Angeles County, California.

Wish I could help you on this one, but am in Michigan and don't know much about the laws of California. Funny I read this though because I rode with a friend to a dr.'s appt. in Detroit (She has Parkinson's Disease and recently underwent brain surgery). Anyway, her brother threatened to commit suicide and called his therapist on a Friday afternoon who came over, talked him down and took his gun but couldn't get him admitted to a psych ward because he didn't meet all the criteria like your daughter. He snapped on Saturday, went to his neighbor's and got his gun and shot himself. Insurance, laws, and all that crap should not matter when someone is crying out for help. I wish you and your husband luck getting your daughter the help she needs.

Hey Vw...how goes it today! Sorry about all this crap happening with K. You are such a strong woman to get through this sober. That in itself is something to rejoice over. You are an inspiration and a good friend! Keep us posted when you can. I have emailed you a couple of times but I think they aren't going through again. Let me know if you got them.

Hey Val, I just sent an email to your work email....did you get it? I'm holding up okay, maybe a little stronger today...have to do my errands and chores...life still goes on and yes, you are right, I need to rejoice over the fact that I'm not drinking and using over this whole thing...but God's got me covered and I can't believe the strength I have surrounding this as well as the energy that is bestowed on me each day. I am one grateful lady. Hope you are doing well!
