i got a question concerning a narcotic contract that i signed with my doctor years ago, anyhow just a short time back i had an appt with my pain doctor that i verbally cancelled on the phone and the reciponist asked why and i told her that i have not been takeing my pain meds as perscribed and i was no longer in pain which was a lie just to get off the phone as quick as possible, anyways she stated that she would make the doctor aware of my situation, anyways a couple days later i recieve a certified letter from the doctor stating that he was dropping me as a patient for violation of the narcotic contract, anyhow today i get another letter from the doctor wanting me to sign my confession of guilt on violating the narcotic contract, now what i'm worried about is can he take legal action against me for not takeing my perscription as perscribed,or is he just wanting this to put in his file,i always thought the only time you could get into trouble is if you doctor shopped which i have never done,if anyone has a clue on this matter please let me know before i have a heart attack..........vinny.
I had to do the same thing, but I broke it by taking too much! I don't think it would even stand up in court, but i am no lawyer. Especially since you haven't seen your dr. in a long time. I would ignore it or send it back unsigned telling them they could talk to your attorney. Bet you don't here from them. Your records say it all.
vinny,
this 'contract' is basically a convennat of trust between you and your doctor it is a contract only in the sense of the word that it outlines that if you dont do this or do do that... like lie or misuse your narcotics this is what will happen..ie he will drop you from his practice.... this is not a legally binding per se as a prosecution tool in the criminal sense in and of itself.... however... the primary reason is that he wants your confession to cover said a**... cause if he dropped you and you have a w/d type problem or a related problem and he didnt do an exit appt you 'could' have a legal groud to persue a claim against him for any damage you might suffer... however since you are already past the worst of the w/d this is moot.. (but he prolly dont know how far along you are in this process...) also this contract is an instrument that is used to show the patient just how dangerous these meds can be....
as for the confession.... well surprisingly.... I would not do this... you have already burned your bridge in this regard .... documenting in your own hand for your record is redundent and you never know who and how in the future it might be viewed for ..... you have made a verbal confession and he has dropped you... this should be enough... this is not the same as not going to treatment for fear of a paper trail ... this is a little different this ' confession' only serves to protect him from liability and that is not your responsiblity as this point... your side of the street is clean so to speak... if he is sooo worried about your 'confession' why dont he call you or communicate via a more personal manner than a cerified letter... sorry but this is a cowardly and insensitive manner to handle this situation..... now I am on my soap box....lol..
best of luck to you dear vinny.. just my opinion....

Hi Vinny, I cannot say for sure but my guess would be that it is a little CYA by the doctor. Something to keep on file to show that you were not taking the meds as directed and to keep himself from being liable for any problems you may encounter from the misuse of the drugs that he prescribed. Like I said, just a guess but seems logical to me.
I love reading your posts Vin, you seem like a great guy. I hope all goes well for you.
